"FIDEOJOY", through its website www.fideojoy.com, offers a personalised service (hereafter the "Personalised Formulas") for linguistic exchanges and Au Pair experiences and a system for connecting Christian families via a platform (hereafter "the Platform"). The Platform is operated by the company FIDEOJOY, 3 chemin de Pouilly, 69570 Dardilly, FRANCE (hereinafter also referred to as "FIDEOJOY", "we", "us", or similar).
Persons who have registered with FIDEOJOY will hereinafter be referred to as "Users", "you", or similar.
FIDEOJOY and the User are hereinafter referred to together or individually as a "Party".
The purpose of these general terms and conditions (hereinafter the "General Terms and Conditions" or "T&C") is to set out the terms and conditions for the provision of the Services provided by FIDEOJOY to Users, as well as to define the rights and obligations of the Parties in this context.
2.1 "FIDEOJOY" is an internet portal allowing Christian families and young Christian adults from different countries, "Users", to connect through this network "(hereinafter the "Network") and have the possibility :

This means that the users registered on FIDEOJOY, once the connection has been made, will themselves have to contact each other to establish the terms of the relationship. (dates, duration, conditions, etc.).
FIDEOJOY provides them with support in this process, but it is up to each user to comply with the rules in force in each country. cf. article 4.4.
2.2. For the purposes of these General Terms and Conditions of Sale and Use, "the profile" refers to the personal page created on FIDEOJOY that the "User" may personalise with text and photos. All Users may introduce themselves and express their expectations regarding the host family/au pair they are looking for in the "search" function.
2.3 "Our offer" or "services" refers to all the free or paid services available to FIDEOJOY users:
either via the networking platform
or by offering personalised services (hereinafter "Personalised Services") proposed by us or our contractual partners, which we sell to our members or clients, in our own name and on our own account. These services include, in particular, stays with host families or teachers and stays in schools or Summer Camps.
We inform you of the terms and conditions for the acquisition of the personalised service on our website. According to your request and your criteria, we will study the most suitable formula and make you a personalized proposal. These personalised Services are totally independent of the contacts made by the platform and are the subject of specific contracts which replace the present General Terms and Conditions.
2.4. The referral platform works with a sponsorship system, which is necessary for the activation of the profile. Any User, once his/her profile has been validated, may sponsor other Users awaiting validation of their profile and/or any User already a member of the Network (hereinafter the "Sponsors").
These General Terms and Conditions of Use and Sale apply to the use of FIDEOJOY. By registering, the User accepts these General Terms and Conditions of Use and Sale, which become an integral part of the contract upon registration on FIDEOJOY. The contract between FIDEOJOY and you will take effect with registration. Use of the FIDEOJOY website and registration for one or more of its services are subject to your full and complete acceptance of the General Terms and Conditions of Use and Sale. By ticking the box "I accept the Code of Ethics, the General Terms and Conditions of Use and I certify on my honour that I am of legal age", you acknowledge that you are fully informed and that you accept and agree to abide by the rules of all the provisions of these General Terms and Conditions. Any conditional membership is considered null and void.
In the event of use of a personalised FIDEOJOY service, they may be supplemented by special conditions indicated in the contractual document "Application for Participation in Stays" signed by the User and FIDEOJOY.
If you do not subscribe to these FIDEOJOY General Terms and Conditions of Use and Sale, you should not use the Services and the platform and we thank you for leaving the site.
4.1. Conditions of access to personalised services and the platform
The personalised Services and the Platform are accessible to any natural person who has full legal capacity to enter into a commitment under these General Terms and Conditions and who is at least 18 years of age. Personalised Services and the Platform are not accessible to legal entities.
Any natural person looking for his family to host a young Au Pair can register as a family.
Any natural person, young adult 18 years old and over, looking for a family to host a young au pair can register as a family.
Only natural persons who have reached the age of majority can register. However, persons who are not yet 18 years old and who are looking for a host family to stay as an au pair once they have reached the age of 18 years can register. In this case, the User declares that they have registered with the consent of their legal representative, which they may prove without delay at FIDEOJOY's request; if proof of the consent of the legal representative cannot be provided, we will exclude the User in question from our platform until they have reached the age of 18.
Managers and employees of agencies of language organizations or au pair placements, as well as their spouses or partners and other competitors of FIDEOJOY may not register.
In addition, access to the platform is subject to obtaining sponsorship from the platform administrators. Users are also required to have a minimum of 2 sponsors in the network.
The User declares that he or she is aware of and accepts FIDEOJOY's Charter of Values, which if not respected may lead to exclusion, see article 6.8.
4.2 Operation and Rules of Sponsorship
A sponsor is a person who is already registered on the platform and has therefore met the conditions detailed in 4.1.
In the case of a User who is looking for Sponsors, the User acknowledges and accepts that potential Sponsors are sought exclusively among his contacts. The User therefore expressly authorises FIDEOJOY to search for persons who are Users who are members of the Network in its contact list attached to the email address and/or social network account used during registration and to contact them, by any means deemed useful, to offer them the opportunity to sponsor him/her. Data of users who are not in the network are not stored.
All Users expressly authorise FIDEOJOY to collect their email address when another User is looking for sponsors and to contact them for the purpose of notifying them of a sponsorship request, by any means deemed useful by FIDEOJOY.
The User acknowledges and accepts that sponsorship notifications are sent directly by FIDEOJOY to its contacts. The User shall access in his or her Personal Space the list of his or her Sponsors who have agreed to sponsor him or her.
Any potential Sponsor contacted by FIDEOJOY may, at his or her free choice :
The User awaiting validation of his Account accesses the list of his Sponsors in the "Sponsorship" tab of his Personal Space. The User acknowledges and accepts that he cannot access the list of Users who have refused to sponsor him. FIDEOJOY undertakes not to disclose to the User concerned the names of Users who have refused to sponsor him/her.
FIDEOJOY shall validate the User's Account once it has obtained the sponsorship of at least two (2) Sponsors and an Administrator. In some cases, it is possible to obtain access to the network by sponsoring an administrator only.
Access to the network is conditional on the sponsorship of the administrator.
Any User who is a member of the Network can sponsor other Users who are already members of the Network, when he receives the request, by clicking on the "Sponsor" button provided in the Sponsorship tab of each User.
Any User, once his Account has been validated, can also search for potential new Sponsors by going to his Sponsorship tab profile. FIDEOJOY will send notification of sponsorship requests only to potential Sponsors chosen by the User.
All Users access the list of their Sponsors and the Users they have sponsored in the "Sponsorship" tab of their Profile.
4.3. Personal use
All registrations must be made in person by the User. Registration by a third party or agent is not permitted. Each User may only register once. The User of the Services is considered to be the person whose personal information corresponds to that provided in the creation of the Profile, to the exclusion of any other third party.
The User therefore undertakes to use the Services personally or for his children or assigns, and not to allow any third party to use them in his place or for his own account, including another User of the Services, unless he bears full responsibility for them.
The User is furthermore responsible for maintaining the confidentiality of his identifiers and passwords and expressly acknowledges that any use of the Services from his Profile will be deemed to have been made by himself.
In the event that the User finds that his or her Profile is or has been used without his or her knowledge, he or she undertakes to notify FIDEOJOY as soon as possible, at the address indicated in Article 1.
The User undertakes to create only one Profile. FIDEOJOY reserves the right to delete any other Profile created by the same User.
The User also acknowledges that they have been informed that if FIDEOJOY decides to suspend or delete their Profile, the User may no longer create a new Profile on the Platform. If the User attempts to create a Profile again, FIDEOJOY reserves the right to delete it.
In the General Profile, the User may obtain the label "Verified Profile" which enables him/her to inspire even more confidence in other Users. Obtaining this label is based on the verification by the FIDEOJOY team of several elements: profile photos, email address, telephone number, links to the user's social networks (Facebook, LinkedIn) and identity document. The administrator alone can decide to award this label.
4.4. Matchmaking process
Once a user has access to the network via administrator sponsorship, they can search on their own for another user with whom to establish a language experience via the "Your requests for connection" tab.
The user can select multiple search criteria. He can thus consult the profile of several users and ask to be put in contact with them. Matching requests are limited to 2 in parallel for Au Pairs and 1 for youth exchanges. The user undertakes not to ask for a match-up lightly. Any abuse will lead to the user's exclusion from the FIDEOJOY network.
The user makes a request for contact (requester) on the basis of information entered by another user (recipient).
The recipient has the option of accepting the request for contact, refusing it or asking for a period of reflection.
If the recipient accepts the request, the requester first confirms the matchmaking by paying for it. It is then up to the recipient to pay. Once the payments have been made by the applicant and the receiver, each receives the contact details of the other.
4.5. Compliance with country regulations and legislation
Each User certifies that the content of his or her profile does not infringe on the regulations in force, nor on administrative prohibitions, public order or good morals, as well as on the regulations relating to the au pair stay in force in the respective host country, for users considering an Au Pair experience (families or young adults).
Before registering, each family wishing to host an Au Pair must find out about the legislation in their country (country of residence) relating to the right to host young Au Pairs.
Each young Au Pair must make sure that he or she can be hosted as an Au Pair in the desired host country under the legislation in force in that country.
Au Pairs must be at least 18 years old.
In the case of language exchanges between families, in the case of hosting a young minor, it is recommended to request a criminal record extract for all adults present in the family. This extract may be requested by the sending family if the young person is under the age of majority. This practice is common in some countries, particularly in Anglo-Saxon countries, and should not be seen as a lack of confidence but as a legal security measure in the host country or a measure of custom in the sending family's country of origin. For France, this procedure is free of charge and can be done online at https://www.cjn.justice.gouv.fr/cjn/b3/eje20 and must be obtained within 2 weeks.
4.6. Non-commercial use
Only registrations aimed at establishing a relationship between families or between families and young adults for the purposes indicated in Articles 1. and 2. are permitted. Enrolment for any other purpose, whether professional (direct or indirect commercial placement of au pairs or host families or stays for young people), commercial, advertising, promotional or any other non-private purpose, is expressly prohibited.
4.7. Penalties
Any person infringing the prohibition in Article 4.6. by registering on FIDEOJOY for a purpose other than that authorised shall be liable. FIDEOJOY reserves the right to bring an action for damages.
5.1 Free of charge
Registration on the FIDEOJOY platform as a family or young adult is free before the contact is made and for any use in accordance with the contract.
The registration of each user is free and allows him/her to create his/her profile by filling in a precise questionnaire, and also gives the possibility to add photos and free text. Once you have completed your search via the search engine, you can request a contact with the family or young adult of your choice. After obtaining their agreement and paying the fees, you will get their contact details.
5.2. Prices
Prices are communicated on a case-by-case basis according to the customer's request.
Unless expressly agreed otherwise between you and us, the prices indicated on our website are binding. Unless otherwise stated, prices are in euros. They are inclusive of all taxes.
Payment of the entire price is made in one instalment.
5.3. Terms of payment & General terms of payment via Stripe
The User must make his payments secured by the STRIPE system. FIDEOJOY reserves the right at any time to modify, add or delete a payment method.
Users are expressly informed and accept that all payments made through the Application and/or the Platform are managed by the company Stripe Inc, which is licensed as an Electronic Money Institution by the U.K. Financial Conduct Authority (https://stripe.com/sp ukl/legal) (hereinafter referred to as "Stripe"). Users contract directly with Stripe with regard to the implementation of these financial transactions, by accepting Stripe's General Terms and Conditions accessible via the following link: https://stripe.com/fr/privacy, and to which reference is expressly made, acceptance of these General Terms and Conditions according to the terms set out in Article 3 thus expressly implies acceptance of Stripe's General Terms and Conditions. In the event of contradiction between the general terms and conditions of Stripe and these General Terms and Conditions, the latter prevail.
Within the framework of the Services, Users transmit to Stripe all their instructions relating to payments through their Personal Space. Consequently, Users expressly mandate FIDEOJOY to transmit said instructions to Stripe, in their name and on their behalf.
As the implementation of certain Services requires payment, Users are informed and accept that Stripe's refusal to accept the User's registration as a user of its own services, as well as the termination of the contract between a User and Stripe, for whatever reason, will automatically and ipso jure result in the termination of this contract between FIDEOJOY and that User and, as a consequence, the closure of the User's Account. Conversely, the termination of this contract between FIDEOJOY and a User will automatically and by operation of law result in the termination of the contract between that User and Stripe.
Payment services are provided by Stripe and are subject to the Stripe Connected Account Agreement, which includes Stripe's Terms of Service (the whole being referred to as the "Stripe General Terms of Use" - "Stripe Services Agreement"). By agreeing to these General Terms of Use, you agree to be bound by the Stripe General Terms of Use, which may be subject to occasional modifications by Stripe. Because FIDEOJOY allows payments to be made via Stripe, you agree to provide FIDEOJOY with accurate and complete information about you and your activity, and authorise FIDEOJOY to share this information as well as information concerning transactions made via the payment solution provided by Stripe.
5.4. Invoices due
Invoices are due immediately.
6.1 - Convention of evidence
The fact that the user ticks the box indicating the sentence "I accept the code of ethics, the general terms of use and I certify on my honour to be of legal age" is tantamount to acceptance of these General Terms of Use and constitutes an electronic signature which has, between the parties, the same value as a handwritten signature.
6.2. FIDEOJOY's charter of values and rules of good conduct
The user undertakes to be honest, respectful, polite and caring towards other users and FIDEOJOY. Upon registration, by signing the Charter, He commits himself to exchange in truth in an authentic climate, respecting the human, family and spiritual values of this Catholic network. If it is not respected, may lead to exclusion, see article 6.8.
6.3. Data collection and accuracy
Any User by creating his profile can personalize it with texts and photos. The data requested during registration, such as surname, first name, address, telephone number and valid e-mail address, must be complete and correct. FIDEOJOY reserves the right to check the accuracy of the data on a case-by-case basis and to ask the User, where necessary, for the necessary supporting documents (e.g. copy of identity card, passport, credit card(s) or telephone bill). The data provided must correspond to the data mentioned in the official identity documents of the person registering. In the event of inaccuracies in the data, the User is obliged to correct the entered data himself/herself immediately.
The User is solely responsible for the content of the profile presented on FIDEOJOY, in particular its accuracy and lawfulness, as well as for the texts entered or photos uploaded. Any inaccuracy or negligence in the profiles published on FIDEOJOY by families or young people is the sole responsibility of the User. It is the responsibility of the User to have the rights to any image published by him/her.
The User undertakes to :
The User is obliged to respect the rights and interests of other Users or third parties, and in particular the rights of the person. FIDEOJOY shall in no way be liable for the accuracy of the information published by any person (host families and au pairs).
The User shall be liable for any damage suffered/to be suffered by FIDEOJOY in any way whatsoever as a result of the representation and/or use of his or her profile, unless the damage is not attributable to him or her.
FIDEOJOY reserves the right to refuse or correct texts and advertisements in your profile that contain editorial errors, abbreviations, codes, personal contact details or any comments that do not fall within the scope of the purpose of the site and these general terms and conditions of use, or that contravene FIDEOJOY's charter of values.
You acknowledge and agree that FIDEOJOY reserves the right to collect and use IP addresses in order to hand them over to the competent authorities (justice, police, access provider) if necessary, and in order to identify Internet users who contravene these General Terms and Conditions of Use and Sale and the general rules of private law.
6. 4. Confidentiality of other users' data
The data transmitted to the User (in particular contact details and personal messages) concerning families and young adults Au pairs and students are strictly confidential and may not be published elsewhere (in particular on other websites or other media) or disclosed to third parties. It is forbidden to pass on contact details to other Users or third parties. Users may only use FIDEOJOY and the data obtained in the course of its use for the purposes defined in paragraph 2. In the event of infringement, Article 6.8 shall apply.
6.5 Prohibition of links to third party sites or direct contact information
It is not permitted to enter contact details, links or references to other websites in fields or texts not expressly provided for this purpose. This also applies to blank text fields. Contact data is defined as all data that enables a person to be contacted without having to pay the costs of the contact. In the event of an infringement, FIDEOJOY reserves the right to no longer display or delete the User's profile, as well as to charge commission fees or claim damages.
6.6 Unavailability of the User
The User may notify FIDEOJOY of his or her unavailability as an au pair family/youth. Simply tick in the General Profile" tab "nothing for the moment" so that the User cannot be contacted temporarily but his or her profile will remain visible as unavailable.
6.7 Right of Withdrawal
In accordance with Article L221-28 of the French Consumer Code -12) -13), FIDEOJOY provides a digital service whose performance begins after the user's prior agreement and express acceptance by the user to waive his right of withdrawal.
Any User may request to have their profile deactivated so that it is no longer visible to other Users. Their request must be sent to FIDEOJOY by email [email protected].
6.8. Exclusion procedure
In the event of failure to comply with these General Terms and Conditions of Use and Sale or the Charter of Values, the rules of good conduct, good morals or the rights and legal provisions in force, the rights of third parties or where FIDEOJOY has a legitimate interest, FIDEOJOY may exclude any User from using the services (personalised services and platform) without having to justify its reasons.
In the event of exclusion in accordance with Article 6.7, the User may not claim any total or partial reimbursement of the connection costs. In the event of breach of these Terms and Conditions of Sale and Use, any sums paid to FIDEOJOY shall not be refunded, but shall be retained as a contractual penalty.
Upon exclusion, the User shall no longer have the right to use FIDEOJOY. Nor may the excluded User re-register.
FIDEOJOY also reserves the right to refuse or delete any registration, without reason and without warning.
7.1 Service guarantees and developments
The possibilities of use mentioned in these General Terms and Conditions of Sale and Use are subject to technical availability and are only valid within the scope of the state of the art. FIDEOJOY shall make available on the Internet an offer that corresponds to the current state of the art. However, the User is informed that there are no error-free programs available on the Internet at the current state of the art. The User is furthermore informed that the desired data may not always be available or may not be available at all.
In the event of a system failure, the registered User may not claim the use of FIDEOJOY, and therefore may not claim damages.
If FIDEOJOY is responsible for any disruptions or interruptions to the agreed services, the response time during the connection will be extended by the duration of the disruption.
FIDEOJOY's offer is not static, but is continuously developed and adapted. New functions can therefore be introduced or existing functions can be removed. Each User shall be informed in advance by e-mail and within a reasonable period of time of the planned interruption of essential functions.
FIDEOJOY shall make the technical device available so that contact between Users is generally possible. There is no guarantee that a registered User will find a suitable User after matching the search criteria. FIDEOJOY shall not be liable for the accuracy of the data entered by families and young adults, nor for their respective availability. FIDEOJOY shall therefore not be held liable if no contact is made during the period of use.
7.2. Data privacy policy
FIDEOJOY points out that all data published on the Internet may be copied. FIDEOJOY endeavours to prevent this as far as possible. However, FIDEOJOY cannot be held liable if profile data published on FIDEOJOY is copied and published elsewhere. The User is obliged to hold FIDEOJOY harmless from any claims made by third parties resulting in any way whatsoever from the publication of the User's profile.
RGPD: our privacy policy is accessible on our website.
Our privacy policy has been updated in accordance with the General Data Protection Regulations (RGPD) applicable as of 25 May 2018. The GDPP allows you to better control your personal data and the use made of it. Following your registration on the FIDEOJOY platform, the personal data collected will not be passed on to other organisations.
The site is closed to search engines (Google...), your identity, your ads and other data are by default invisible to non-members and robots.
We implement the necessary security measures to protect the data exchanged (https encryption).
Your information can be communicated to you or deleted on simple request via the contact form or by email to [email protected].
Without any change on your part, your personal data will be kept in our database in a secure manner for a period of 5 years.
7.3. Limitation of Liability
FIDEOJOY's responsibility stops at the provision of contact details and the putting of persons in touch with each other, with no guarantee of the consequences of this contact. In particular, it is the responsibility of each user to ensure that the person they have been put in contact with corresponds to their needs and expectations. Under no circumstances does FIDEJOY guarantee the morality of users. Although FIDEOJOY makes every effort to accept only sponsored persons, it cannot guarantee the good character of such persons and cannot be held liable for them. FIDEOJOY remains subject to the laws in force in the host country. Neither FIDEOJOY nor the representatives of the State of which it is a citizen may, by virtue of this contract, keep it out of the application of the penalties provided for in the event of illegal acts. In the event of legal proceedings, the participant and his parents or legal representatives shall be liable for all costs incurred.
You are obliged to take all necessary and honestly to be expected from you to avoid and minimize damages. Failure to comply with this obligation may be interpreted as co-responsibility which may result in a reduction of the compensation due to you.
We would like to point out that FIDEOJOY's role is only to provide a platform for families and young adults to get in touch. To this end, FIDEOJOY provides advice which, to the best of its knowledge, reflects the laws and regulations in force. These texts serve exclusively to inform the User. FIDEOJOY cannot guarantee or be held liable for the completeness, accuracy or relevance of this information. Users must themselves check with the competent authorities to find out whether they can legally host a young person or an au pair or be received as a young person or au pair in a host family in the desired host country. see Article 4.4 Compliance with regulations and legislation of the countries
We stress that we do not personally know all families and young people. Therefore, we cannot guarantee that families and young people are trustworthy and respect their commitments.
However, in order to propose a network of families sharing the same family and catholic values (see our charter of values (link to be done), FIDEOJOY provides a technical tool allowing the sponsorship of members and thus ensuring more trust and shared values that facilitate more adequate meetings. cf article Functioning and rules of Sponsorship 4.2
Users decide for themselves when and with whom they wish to contact. We have no influence on the smooth running of the contact between a family and a young adult or between families among themselves, on its positive or on the contrary negative evolution for one of the parties. Furthermore, FIDEOJOY cannot be held liable if no relationship is established between Users or if it does not conform to Users' expectations.
In particular, FIDEOJOY cannot be held liable in the event of payment fraud.
FIDEOJOY will act as a moderator of the content published, but may not be held liable for any abuses (insulting remarks, false statements, etc.) or for the publication of protected content.
8.1. Language of the contract
The languages available are English and French. (!!!!) In the event of a translation of these General Terms and Conditions into one or more languages, the language of interpretation shall be French in the event of a contradiction or dispute as to the meaning of a term or provision.
8.2. Modification of the General Terms and Conditions
FIDEOJOY reserves the right to modify these General Terms and Conditions at any time. In particular, FIDEOJOY reserves the right to modify and/or stop offering all or part of the Services at any time at its own discretion.
The User shall be informed of such modifications by any useful means, at least fifteen (15) days before they come into force. The modified General Terms and Conditions will apply immediately to all Users of the Services as soon as they are put online on the Platform and/or on the Application.
Users who do not accept the modified General Terms and Conditions must unsubscribe from the Services.
Any User who makes use of the Services after the entry into force of the modified General Terms and Conditions is deemed to have accepted these modifications, which will be fully applicable to him/her.
8.3. Nullity
The nullity of one of the preceding provisions shall not entail the nullity of the other provisions. The User undertakes to consent to the replacement of the null clause by a valid provision that best corresponds to the economic objective sought by the parties.
8.4 Intellectual Property
These General Terms and Conditions do not grant the User any intellectual property rights of any kind over the Platform and/or the Application, as well as over all the texts, images, audio-visual and other content used by GDC on the Platform and/or the Application, with the exception of Content put online by Users, including these General Conditions, brands, trade names and logos, software, structures, infrastructures and databases used by GDC within the Platform and/or the Application, which remain the full and entire exclusive property of GDC.
Any act of disassembly, decompilation, decryption, extraction, reuse and, more generally, any reproduction, representation, distribution, adaptation, commercialisation of the Platform and/or the Application and/or the texts, images, audio-visual content and other content used by GDC on the Platform and/or the Application by the User, without the authorisation of GDC, and which does not comply with the provisions of these General Terms and Conditions, is prohibited and may be subject to legal proceedings.
FIDEOJOY may transfer to a third party, in whole or in part, its rights and obligations hereunder, subject to four weeks' notice.
The place of performance of the contract shall be Lyon, France.
The courts of Lyon, France, shall have sole jurisdiction to settle all disputes arising in connection with the contract. However, FIDEOJOY reserves the right to take action against the User before any other competent court.
French law shall apply to all legal relationships between the contracting parties, with the exception of the United Nations Convention on Contracts for the International Sale of Goods (CISG), if no mandatory legal provisions, in particular those relating to consumer protection, prevent this. In case of doubt, only the French version of these General Terms and Conditions of Sale and Use shall be binding.
